These Terms of Use (“Terms”) govern your access to and use of SignalRelief.com (the “Website” or “Site”). If you do not accept these Terms, or you do not meet or comply with their provisions, you may not use the Website.

These Terms apply to all users of the Website and to all transactions made on or through this Website.

This Agreement is intended to be governed by the Electronic Signatures in Global and National Commerce Act. You manifest your agreement to the terms and conditions in this document by any act demonstrating your assent, including clicking any button containing the words “I agree” (or similar), or by merely accessing the Website, whether you have read these Terms or not. Any modifications take effect when posted. Each time you access the Website, you should review the then-current Terms. By continuing to use the Website after changes are posted, you will be deemed to have accepted the changes.

3) Jurisdiction

The Website is directed to individuals and entities located in the United States. It is not directed to any person or entity in any jurisdiction where the publication or availability of the Website, its content, products, or services is unavailable or otherwise contrary to local laws or regulations. If this applies to you, you are not authorized to access or use any information on this Website.

SignalRelief.com makes no representation that the information, opinions, advice, or other content on the Website (collectively, “Content”) is appropriate or that its products and services are available outside of the United States. Those who choose to access this Website from other locations do so at their own risk and are responsible for compliance with applicable local laws.

4) Scope of Use and User Email

You are authorized to view, use, copy for your records, and download small portions of the Content (including text, graphics, software, audio and video files, and photos) for informational, non-commercial use, provided that you keep all copyright notices (including copyright management information) and other proprietary notices intact.

You may not store, modify, reproduce, transmit, reverse engineer, or distribute a significant portion of the Content on this Website, or the design or layout of the Website (or individual sections of it), in any form or media. Systematic retrieval of data from the Website is prohibited.

Email submissions over the Internet may not be secure and may be intercepted by third parties. Please consider this fact before emailing information. Please also review our Privacy Policy.

The commercial use, reproduction, transmission, or distribution of any information, software, or other material available through the Website without our prior written consent is strictly prohibited.

5) Copyrights and Trademarks

The materials on this Site, as well as the organization and layout of this Site, are copyrighted and protected by U.S. and international copyright laws and treaty provisions.

You may access, download, and print materials solely for your personal and non-commercial use; however, any printout of this Site (or portions of the Site) must include SignalRelief.com’s copyright notice.

No right, title, or interest in any materials is transferred to you as a result of accessing, downloading, or printing such materials. You may not copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works from, link to, or frame this Site in another website, use it on any other website, transfer, or sell any information obtained from this Site without Signal Relief’s prior written permission.

6) Links

For convenience, we may provide links to third-party websites. Signal Relief does not control or endorse third-party websites and is not responsible for their content, or for the accuracy or reliability of any information, data, opinions, advice, or statements contained within them.

Please read the terms and policies of any third-party website you visit. These Terms apply only to Signal Relief’s Website and the products and services Signal Relief offers. If you decide to access any third-party sites linked to this Website, you do so at your own risk.

Signal Relief reserves the right to terminate any link or linking program at any time and disclaims all warranties, express or implied, as to the accuracy, validity, or legality of materials or information contained on third-party sites.

7) No Unlawful or Prohibited Use

As a condition of your use of the Website, you warrant that you will not use the Website for any purpose that is unlawful or prohibited by these Terms. You may not use the Website in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Website.

You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

8) Spamming

Gathering email addresses from SignalRelief.com via harvesting or automated means is prohibited. Posting or transmitting unauthorized or unsolicited advertising, promotional materials, or other forms of solicitation to other users is prohibited.

Inquiries regarding a commercial relationship with Signal Relief should be directed to support@signalrelief.com.

9) Order Processing

After the pre-order period has ended, any order placed by 10:00 a.m. Mountain Time (Monday–Friday) for Standard (Ground) or Economy (SmartPost) service will be processed and shipped the same business day. Orders placed after 10:00 a.m. Mountain Time for these services will ship the next business day.

Any order placed by 1:00 p.m. Mountain Time for Express service (Next Day or 2-Day) will be processed and shipped the same business day. Orders placed after 1:00 p.m. Mountain Time for these services will ship the next business day.

Signal Relief does not process or ship orders on weekends, holidays, or during severe weather conditions. Orders placed during such times will be processed and shipped the next business day.

Once an order has been processed, adjustments and cancellations cannot be made.

10) Shipping

Signal Relief ships within the United States, including U.S. territories and military addresses, as well as to select international locations. 

Signal Relief uses USPS, Smart Post, FedEx, UPS, or a combination of such carriers.

  • Economy: 5-8 Business Days, not guaranteed. (USPS)

  • Expedited: 2-3 Business Days, not guaranteed. (FedEx) 

  • Express: 1-2 Business Days, not guaranteed. (UPS)

  • PO Boxes: Must use Economy service. FedEx and UPS cannot deliver to PO Boxes.

It is the customer’s responsibility to ensure that the shipping address and selected shipping method are complete and correct before submitting an order.

Orders are not fulfilled outside of Signal Relief's regular business hours. 

Depending on service and location, domestic shipments can take up to 10 business days for delivery.

Depending on location, international shipments can take up to 15 days business days for delivery.

Shipping date count does not start until an order has been fulfilled.

International shipments are delivered by the destination country’s postal service or by FedEx International. FedEx International does not ship to PO Boxes. 

Signal Relief does not guarantee arrival dates or times. Signal Relief does not refund, credit, or upgrade shipping for any reason.

11) Billing Errors

If you believe you were billed in error, notify Customer Service immediately. If we do not hear from you within 30 days after a billing error first appears on any account statement, the billing will be deemed accepted by you for all purposes, including resolution of inquiries made by your credit card issuer.

You are deemed to have released Signal Relief from liabilities and claims of loss resulting from any error or discrepancy not reported within 30 days of its appearance on your credit card account statement.

12) Your Representations

You represent that you are at least 18 years of age and will not permit a person under 18 to order product from our Website.

You represent that the information you provide when placing an order is up-to-date, materially accurate, and sufficient for us to fulfill your order.

You are responsible for maintaining and promptly updating your account information and for keeping your account credentials secure against unauthorized access.

Unless otherwise agreed or required by law, any warranties provided in relation to the product extend only to you as a user and not as a re-seller. You may not re-sell, re-distribute, or export any product ordered from the Website.

You agree to pay for products and any applicable taxes, shipping, or handling as specified at checkout. Payment must be made prior to delivery using the methods indicated on the Website (unless we approve alternative methods in advance).

13) Typographical Errors

If a product is listed at an incorrect price or with incorrect information due to typographical error or pricing/product information errors received from suppliers, we may refuse or cancel any orders placed for that product—whether or not the order has been confirmed or your credit card charged. If your credit card has been charged and your order is canceled, we will issue a credit in the amount of the charge.

14) No Warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, STATUTORY, OR IMPLIED. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, all of which Signal Relief expressly disclaims.

Signal Relief does not endorse and makes no warranty regarding the accuracy, completeness, currency, or reliability of the Content. We have no duty to update the Website or Content.

We do not represent or warrant that use of the Website or Content will be uninterrupted or error-free. You are responsible for results and consequences of accessing and using the Website and for taking precautions to ensure any content obtained is free of viruses or other harmful components.

Some states do not allow the disclaimer of implied warranties, so some or all of the above may not apply to you.

15) Termination

We reserve the right to terminate your access to or use of this Website and/or your subscription should we believe you have violated these Terms, or if we believe you have sought, in bad faith, chargebacks, creditbacks, product returns, discounts, or engaged in conduct designed to injure, harass, or disrupt this Website or our business operations.

16) Fraud

We reserve the right (but have no obligation) to report and prosecute suspected credit card fraud. We may require further authorization (such as telephone confirmation) or additional information.

We may cancel, delay, refuse to ship, or recall an order if fraud is suspected. We capture certain information during the order process, including time, date, IP address, and other information that may be used to identify individuals committing fraud. Use of multiple accounts may be prohibited.

If an order is suspected to be fraudulent, we reserve the right to submit records (with or without a subpoena, as permitted by law) to law enforcement and to the credit card company for investigation and to cooperate with authorities.

17) Sales Tax

Signal Relief is considered a wellness product and is subject to sales tax. You are responsible for paying any sales tax indicated on the Website.

18) Terms and Conditions of Sale (No Resale / No Dropshipping)

Signal Relief products are intended for personal use or gifting and are not labeled for resale. Commercial resale is strictly forbidden.

You agree you will not use Signal Relief as a drop shipper and will not enter order and shipment details on the Website such that Signal Relief ships products to your customers.

19) Foreign Transaction Fees / Duties

In some instances, billing for your product or shipping fee may originate outside of the U.S., and your financial institution may charge a processing fee. You are responsible for these fees per your cardholder agreement.

All transactions are processed in U.S. dollars (USD). Signal Relief is not liable for import fees, duties, or customs fees applied to international orders.

20) Governing Law; Location; Miscellaneous

These Terms shall be governed in all respects by the laws of the State of Utah, Utah County, USA, without reference to conflict-of-law rules. If an applicable law conflicts with any part of these Terms, the Terms will be deemed modified to conform to the law, and the remaining provisions will remain in effect.

21) Separate Agreements

You may have other agreements with Signal Relief. Those agreements are separate and in addition to these Terms. These Terms do not modify, revise, or amend any other agreements you may have with Signal Relief.

22) DMCA Copyright Policy and Copyright Agent

If you believe content on this Site infringes your intellectual property rights, please notify our agent and provide:

  • a physical or electronic signature of a person authorized to act on behalf of the owner of the allegedly infringed right;

  • identification of the copyrighted work claimed to have been infringed;

  • identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it;

  • your address, telephone number, and (if available) email address;

  • a statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and

  • a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner.

24) No Medical Advice

Signal Relief products are consumer wellness products and are not intended to diagnose, treat, cure, or prevent any disease. You should always consult a qualified healthcare professional regarding any medical condition, symptom, or concern, and before making changes to your health or wellness routine.

This Website is not intended for use by minors, and nothing on this Website should be relied upon as a substitute for professional medical judgment, diagnosis, or treatment.

25) User Disputes

You are solely responsible for your interactions with other users. Signal Relief reserves the right, but has no obligation, to monitor disputes.

26) Arbitration

Except for actions seeking equitable relief (including for the purpose of protecting confidential information and/or intellectual property rights), any controversy or claim arising out of or relating to these Terms or this Website shall be settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect.

Arbitration shall be conducted on an individual basis and shall not be consolidated with any claim or controversy of any other party. The arbitration shall be held in Utah County, Utah, USA.

Each party shall bear its own attorneys’ fees incurred in arbitration.

Judgment on the arbitration award may be entered in any court with jurisdiction. Any award shall be the sole and exclusive remedy of the parties, and the parties waive rights to judicial review except as permitted by applicable law.

27) Limitation of Liability

YOUR USE OF THE WEBSITE AND CONTENT IS AT YOUR OWN RISK. To the fullest extent permitted by law, Signal Relief disclaims liability (contract, tort, negligence, strict liability, or otherwise) for any direct, indirect, incidental, punitive, consequential, or special damages arising out of or connected with access to, use of, or reliance on the Website or Content, even if advised of the possibility of such damages.

To the maximum extent legally permitted, our aggregate liability shall not exceed the cost of the products you ordered. Under no circumstances shall we be liable for special, incidental, indirect, or consequential damages, lost profits, lost revenue, or cost of cover.

Some jurisdictions do not allow limitations of liability, so some or all of the above may not apply to you.

28) Indemnity

You agree to defend, indemnify, and hold harmless Signal Relief, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements (including reasonable legal and accounting fees) resulting from, or alleged to result from, your violation of these Terms.

ADDITIONAL TERMS APPLICABLE ONLY TO REGISTERED USERS

29) Accounts and Security

Signal Relief does not warrant that Website functions will be uninterrupted or error-free, that defects will be corrected, or that the Website or servers will be free of viruses or other harmful components.

As part of registration, you may select a login name and password. You must provide accurate, complete, and updated account information. Failure to do so may result in termination of your account.

You may not:

  • select or use a login name of another person with intent to impersonate that person;

  • use a name subject to another person’s rights without authorization; or

  • use a login name that we deem inappropriate or offensive.

You must notify Signal Relief of any known or suspected unauthorized use of your account or breach of security.

Fraudulent, abusive, or illegal activity may be grounds for termination of your account and may be reported to law enforcement.

30) Password Use

If we assign you credentials to access portions of this Website, each use of your password or identification will be deemed authorized. You are solely responsible for all access and use by anyone using the credentials originally assigned to you, whether or not authorized by you, including all communications and obligations incurred.

You are responsible for protecting the security and confidentiality of your credentials and must notify us immediately of unauthorized use or suspected breach.

SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS

These SMS/MMS terms apply to Signal Relief’s mobile messaging program (the “Program”). By opting into or participating in the Program, you agree to these Mobile Messaging Terms and the applicable Privacy Policy (together, the “Agreement”). This Agreement applies only to the Program and does not modify other terms that may govern your relationship with Signal Relief in other contexts.

Note: Your source text contained two overlapping SMS/MMS sections. This version consolidates them into one clean set.

1) User Opt-In

You may opt into the Program through online or application-based enrollment forms or other affirmative opt-in methods. By participating, you agree to receive marketing and transactional SMS/MMS messages at the phone number associated with your opt-in, including via autodialed or prerecorded means, where permitted.

Consent is not required to make a purchase. Message and data rates may apply. Message frequency varies.

2) User Opt-Out

To opt out, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us. You may receive a confirmation message.

You understand these are the only reasonable methods of opting out. Our platform may not recognize altered commands (e.g., modified spellings or adding words), and Signal Relief and its service providers will have no liability for failing to honor such requests.

3) Duty to Notify and Indemnify (Number Changes)

If you stop using the mobile number used to subscribe (including canceling service or transferring the number), you agree to opt out before ending use of the number.

If you discontinue use without notifying us (by opting out), you agree you may be responsible for costs (including attorneys’ fees) and liabilities incurred by Signal Relief or its service providers due to claims by individuals later assigned that number, including claims under the Telephone Consumer Protection Act (TCPA) and similar laws.

4) Program Description

Program messages may relate to the marketing, promotion, payment, delivery, and sale of our products and services, including checkout reminders, order updates, and review requests.

5) Cost and Frequency

Message and data rates may apply. The Program involves recurring messages, and additional messages may be sent based on your interaction with us.

6) Support Instructions

For help, text HELP to the number you received messages from, or email support@signalrelief.com.

Email is not an acceptable method of opting out; opt-outs must be submitted by texting one of the opt-out keywords above.

7) MMS Disclosure

If your device does not support MMS, the Program may send SMS terminating messages (TMs).

8) Disclaimer of Warranty

The Program is provided “as is” and may not be available in all areas at all times. Delivery is subject to your wireless carrier and is outside of our control. Carriers are not liable for delayed or undelivered messages.

9) Participant Requirements

You must have a device capable of two-way messaging, use a participating carrier, and have an active text messaging plan.

10) Age Restriction

You may not use or engage with the Program if you are under 13. If you are between 13 and 18, you must have a parent’s or legal guardian’s permission.

11) Prohibited Content

You agree not to send prohibited content over the Program, including unlawful, abusive, defamatory, or harmful content; malware; unlawful promotions; HIPAA-protected personal health information; or other content prohibited by applicable law.

12) Dispute Resolution (SMS Program)

Any dispute arising out of or relating to the Program or this Agreement will be resolved by binding, individual-only arbitration as permitted by law.

Arbitration location and venue: Your source text referenced multiple locations (Rexburg, Idaho and Provo/Utah County, Utah). Choose one and ensure your SMS terms match your legal strategy.

Arbitration will be conducted in Salt Lake City, Utah, USA  before one arbitrator under the AAA Commercial Arbitration Rules then in effect. The parties agree to individual arbitration only (no class actions).

13) Additional Disclosures

By consenting to Signal Relief’s SMS marketing at checkout and/or via subscription tools, you agree to receive recurring notifications (including abandoned checkout reminders), marketing offers, and transactional texts (including review requests), even if your number is on a state or federal do-not-call list. Consent is not a condition of purchase.

We may change the phone number or short code used to operate the Program at any time. You agree that messages sent to a changed number or short code (including STOP or HELP) may not be received, and we are not liable for honoring requests made in such messages.

To the extent permitted by law, we are not liable for failed, delayed, or misdirected delivery, errors in information sent through the Program, or actions you may take in reliance on such information.
